Lawsuit Against Obama Promised PDF Print E-mail

bolickClint Bolick, Director of the Scharf-Norton Center for Constitutional Litigation at the Goldwater Institute, made his first public announcement in the state Tuesday that the institute's legal team plans to file a federal lawsuit Aug. 12 against the United States President, the Secretary of Health and Human Services, the Secretary of Treasury and the Attorney General.

Socialism and federalism were key topics discussed at the monthly gathering of the Republican Women of Prescott, where keynote speaker Bolin discussed the national deficit, bank bailouts, unemployment, socialized medicine, healthcare freedom and S.B. 1070.

"We are lucky enough to be living in the state that is the prime center of the freedom universe. The Reagan revolution did not start in Washington, it started in Sacramento and I believe the next Reagan revolution is going to be right here in Arizona," he told more than 100 people attending the luncheon at Prescott Resort.

"While Washington is showing what can be done in a socialist government, we are showing what can be done in a free state," he said. "The major issue in the Obama era is federalism. Will power continue to go to Washington, D.C., or will we keep it here, close to home?"

Bolin added that "the battle over S.B. 1070 is a federalist issue, too. We're saying, 'if Washington won't do anything to fix it, we will fix it here.'"

He said he is optimistic that lawsuits filed in other states over the Obama Healthcare Package will prevail, and the case the Goldwater Institute is bringing forward will be the first one in Arizona going after the federal government for violating constitutional rights through the healthcare package.

He said the federal government cannot take away the rights of congressmen who swore an oath to serve their constituents or take away the right of the people to choose their own medical services.

"I'm hoping Arizona will lead to the bringing down of Obamacare and to reintroducing freedom principles in the area of healthcare," he said. "There are three things I am optimistic will get us there. Two of them involve lawsuits and the last is something we all can do to safeguard our nation. Vote and vote for the people who will represent your best interests."

He urged those attending to vote "yes" on the Arizona Healthcare Freedom Act. "It protects our right to make our own medical service decisions without having to go through the government to do it," he said. "This is our declaration of healthcare independence. It's Arizona's message that 'you may take away someone else's freedoms but you will not take away the freedoms of the people of Arizona.'"

Bolin said Arizona Attorney General Terry Goddard "was unwilling to challenge Obamacare, along with other attorney generals around the country. Governor Brewer was given the power by the legislature to challenge the federal law and she joined forces with 19 other states. That litigation is taking place in Florida: It is a state's rights challenge. Basically, health insurance was always a state function, not a federal function. Brewer has joined that lawsuit and I am optimistic she will prevail."

He quoted a 'Reaganism' suiting his mission: "If you can't make them see the light, make them feel the heat."

"On Aug. 12 we will get to sue four lawmakers who I just cannot wait to sue," Bolin concluded.

The suit also challenges the Congressional Independent Payment Advisory Board, tasked with "making sure the costs of the (national healthcare) program do not rise," Bolin said. "The law provides that Congress cannot undo this law and Congress cannot review the decisions of the board and the courts cannot review the decisions of the board.

"I am confident that Obamacare will die of a thousand cuts."

A legal pioneer in a number of areas, Bolick is perhaps best known for his leadership in defending state-based school choice programs. He is the author of several books including, Voucher Wars: Waging the Legal Battle Over School Choice.

Bolick was named one of three Lawyers of the Year in 2003 by American Lawyer. In 2006, he received a Bradley Prize for excellence in "strengthening American democratic capitalism." In 2008, he received the Champion of Law and Liberty award from the Legal Times, which honored him for upholding the legal profession's core values and fighting to expand liberties and protect civil rights. www.goldwaterinstitute.org

The Obama Effect

Last November, the first African-American president was elected into office, at the end of a long, grueling eight year prison sentence with George W. Bush (during which I almost moved to Canada) . I watched the celebration on television, people dancing and crying, hugging each other, Oprah in the crowd along with everybody. This was a truly amazing historical event, and I cried, I did- the blood and pain of my ancestors, the refusal to stop fighting, it all led to this.
Alas, when I turned off the TV, I knew what was coming. All of the racism that was swept under the proverbial rug after the 60’s, all of the prejudice and hatred, was going to rear its ugly head. Because now, a black man was the new leader of the free world—and the undercover racists couldn’t find one valid reason to hate him. I saw this happening, even the day after the election—more and more bald white heads with freshly inked white power tattoos and swastikas on display. Even the people that don’t identify as racists got together and formed the “Tea Party”, an unruly uneducated bunch that disguises their racism by accusing President Obama of all of the things that Bush did.
Obama has been introducing bills and legislature that benefit small businesses and everyone but the wealthy, and the Tea Party members refuse to acknowledge that—after all, if they can’t disguise their racism behind false accusations and rumors, they will have to fess up and admit that they are simply ignorant—or decide not to judge him by the color of his skin. This is too much for these people, so the façade continues, and gets uglier and uglier.
I believe, that had Obama not been elected, the slew of racist and anti-Hispanic laws that have been recently passed (and some that are still in the works), would not be in existence. This outright bigotry is a response to a black president taking office and doing a better job in his first 6 months than the previous white redneck money-grubbing fascist capitalist George W. ever did. It is making some people angry, and these people are reacting exactly the way that you would think they would.
While in office, George W. Bush convinced the American working class white person that he was just like them—an easygoing, God-fearing country boy—a man of the people. All the while, he was working for Big Oil and his Corporation friends, sucking billions of dollars out of our country, and ignoring most important problems and issues that any other president would have addressed (or at least acknowledged); and America ate it up. As long as he tried to make Abortion illegal, as long as he fought against Gay marriage, as long as he blatantly ignored the needs of people of color—he got the majority of the white working class vote (and, of course, the wealthy vote). These Americans were so concerned with these cultural issues that they chose to completely ignore what he was doing to our country.
This is precisely what is happening with Obama, except the other way around. These people are so damn concerned with the fact that he is a black man, or that he has some Muslim relatives, or that he supports gay rights—that they are completely ignoring the good things he is doing for our country—and the money he puts in our pockets.
One can only hope that the truth is a virus that will infect the minds of the ignorant and prejudiced citizens of this country; that they will see the err of their ways, and let go of the regressive old way of thinking that has caused so much pain. That, instead of promoting hate and prejudice, we must come together as a country and show the world that we deserve the freedoms and inalienable rights that our nation was founded upon.
