B. Tom Collins and neighbors re speed limit on Smoketree

Wants to have speed limit changed from 35 mph to 30 mph. It was changed last fall. 

Designated bike trail.

85% of the traffic was going at or below 43 mph.

No traffic accident increase since speed raised. 

Looked at signs, geometrics and more to make decision.

Lamerson asks if more than 85% drivers are going over 35 mph.

Blair asks what that road was designed to do - was it a collector-connector. The road was expected to be a major collector roads. 

The stretch that was increased in speed, there are no frontage properties. 

It was designed for safety as a major collector, so, "Why would we change it?" Blair asked.

Chris asked if he witnessed some close calls? Yes. "I've been one of them."

Ian said that only a minority of drivers would add another 5 miles to the speed limit, but it's not the norm.

"Stop signs don't work. Speed limits don't work. Maybe we need some more cops for enforcment." Lamerson said. 

C. Haley Hyatt of Catholic Charities re "In their shoes ... " community action poverty simulation

Prescott's first poverty simulation to come to town. Looking at connections between poverty and crime, poverty and teenaged pregnancy, poverty and drop out rate. Saturday, February 25. You need to register, only room for 80 individuals.

Music Memory

encouraging classical music for children

Teach the children 4 pieces of classical music. 

They have 4454 children signed up so far. Every child gets a booklet, describes the music, the orchestra, and more.

Music is the true universal language.

111. PRESENTATIONS A. Presentation by the Prescott Area Arts and Humanities Council re a Public Art Policy

Notes that art has been part of Prescott since before the City was founded. 

Points to the mural and artwork in Council Chambers. 

Support, promote and advocate for the Arts. 

Notes that the City's department of tourism supports Art in the community. 

Find and develop a draft of the public arts policy for the City of Prescott. 

I'm going to try to get Cindy's presentation to provide to you here.'

Plans to return in August. 

The Mayor thanks them for taking the challenge on, "It's timely," Kuykendall notes. 

 

B. Presentation of the Willow Creek Road Realignment PARA Study

this study is 100% funded through ADOT. No matching requirement from the City.

Discussing the Sundog Corridor. 

Kate Bondy, Project Engineer

In Yavapai County. 

They expect a forecasted 280% population increase, and a 150% employment increase. 

They plan to validate those numbers.

They believe that they should widen SR 89 to 6 lanes. The planned improvements will not have the capacity to do this. 

In 2035 the traffic volumes will fail and will not handle the traffic. 

Project purpose is to accommodate the level of service of the Willow Creek Road, and wants to improve the intersections. 

Several projects have recommended the realignment of Willow Creek Road.

Roadway and traffic conditions, all intersections operate at level of service, D or better. 

180 crashes reported between 2006 and 2011. 2% fatal (4 crashes)

60% of vehicle-to-vehicle crashes in area.

SR 89 widening design is ongoing. Includes new roundabouts. Yay.

This is a separate study. 

Conceptual alignments.

Bring it off of Willow Creek Road and extend it North. 

Started project in August 2011.

Final plan presented in July, 2012.

Lamerson wants more input, thanks them for coming. "I'm sure staff looks forward to working with you on two distinct projects."

Mayor Kuykendall asks, "Has there been any consideration that some of the traffic volumes ... have those been modified with the economic downturn." 

The projections are lower. Wants to make sure the numbers are accurate, and can be verified.

They've looked at some of the census data, and have made some reductions, but are waiting for CYMPO to update their model. 

The CYMPO model will include the new Willow Creek and where the traffic may diverge. 

"My particular concern, is coming out of the airport, and can only make a right hand turn, particularly for fire protection, go well over 1/2 mile north."

Dallas Hammit, the current ADOT project, will put their design on the southern project on hold, and can match this study. 

Put on hold until June/July.

Road to the West, will be a Prescott project and maybe won't need the 6 lanes. 

Lamerson asks if the water issue is being taken under consideration with the road planning.

They rely heavily on the CYMPO models. 

"What is the burning desire to eliminate Willow Creek Road?" the mayor asks. 

C. Board/Commission liaison reports

Carlow is reporting. CDBG expects to have about $225K to distribute. Meetings this week and next to rank the public requests. 

NACOG: $120K grant put in for now, wants to help about 20 companies with about 40 jobs. NACET is also looking for additional grants.  

Kuknyo said that the wall fell over, did tree trimming and planting. Acker Trust had a good meeting. 

Will be entertaining the mayor of Zeitz, Germany from Feb. 12 - 15? Kuknyo notes that many businesses have pitched in to keep the City from having to absorb the cost. 

Mayor thanks Lamerson for his efforts. 

Arnold is talking about code changes, that might 

Feb. 24, at Yavapai College a Career and Job fair, over 45 vendors looking to hire people. 

Consultation about Channel 15, a government channel only, Channel 13 is looking for opportunities to expand their facilities. 

Hanna - Not much to say, everyone else said it.

Blair - Completed water aspect of General plan. Has attended lots of water meetings. White paper that addressed concerns regarding the USGS study. There's ongoing dialog about the USGS modelling.

 

IV. DISCUSSION ITEMS

A. Discussion of potential changes to the Prescott City Code

The purpose of this workshop is to create a list of items proposed to be added to or modified within the City Code through an eventual formal ordinance adoption process. Each topic identified at the February 7th workshop and placed on the list will be subsequently addressed in more detail at a future workshop.

The following items have been identified; additional ones may be forthcoming from discussion at the workshop.

Craig notes that there is a need to update the City Code. This is to identify a list of items to start with.

 

 

City Manager

Title 1

Personnel and Human Resources - Identify Human Resources as a department and delegate to the City Manager authority to establish regulations and procedures appropriate for administrative promulgation which do not involve creation or modification of fundamental policies of the City which will continue to be set by the City Council. If all the Personnel topics currently found in the Code are retained, impractical, constant updating of the Code will be required to implement ever-changing federal and state requirements [e.g., Family Medical Leave Act (FMLA), Fair Labor Standards Act (FLSA) and other payroll regulations, Health Insurance Portability & Accountability Acts (HIPPA), recruitment processes, pay plan and position classifications, discipline, leave authorization, background checks, retirement and termination guidelines, etc.].

 

The changes would be to personnel and human resources. If the code is too specific, it will be outdated almost continuiously. Reduce it and streamline, only very important policies in the City Code. the details could be handled administratively. 

 

Title 1 Chapter 1-10

Claims Against the City - Update this section and Title 2 Chapter 2-9 Legal Department to accurately set forth current procedures for approval, disapproval, and payment of damage claims, and related indemnification aspects.

 

Pertains to claims against the city - should accurately set forth approval and disapproval for claims, etc.

 

Title 2

Departments (General) - This outdated section of the City Code needs to be revised following adoption of the FY 13 budget to accurately identify and describe the various City departments and their responsibilities. Field and Facilities Services Department

 

Clearly outdated, departments that don't exist, and have changed, etc.

 

Title 2 Chapter 2-13

Field Operations Department; Solid Waste Division - Update the Code to indicate that the Solid Waste Division is now located within the Field and Facilities Services Department, and service is only provided inside the City limits.

 

Example, there is no Field Operations Department any more. New director on board Feb. 13. 

Needs to note that solid waste will not be collected outside city limits.

 

Title 2 Chapter 2-1

Local Limits - An ordinance to define and limit discharge of prohibited substances into the City sewage collection and treatment systems from commercial and industrial users. Federal and state regulations under the Clean Water Act require communities to adopt ordinances for user adherence with Local Limits and pre-treatment of waste discharge from said commercial and industrial sites.

 

Several laws the City of Prescott must comply with. This is outdated, and needs to be updated. 

 

 

Title 3 Chapter 10-11

Water Conservation Code - Updating of Section 11 of this Chapter pertains to restrictions during water shortages that may be implemented by the City Manager specifically related to "safe production" and "total production capability" volumes as defined and quantified in the Code. Pursuant to AR.S. 45-342 the City is required to submit a Drought Management Plan (update) to the Arizona Department of Water Resources every 5 years.

 

Specific numbers about what constitutes safe production - it's not current. If there's an emergency, this code needs to be clarified. 

 

 

Title 8 Chapters 8-1,2

Sidewalks, City Right of Way - Confirm and/or modify, as applicable, respective responsibilities of adjacent property owners and the City regarding maintenance, repair, and replacement of sidewalks, as well as trimming, care, and cleanup of trees, storm damage, etc.

 

About sidewalks and city right-of-way. A tree limb fell on 2 cars. What are the responsibilities of the property owner, and the city? Needs a workshop.

 

Title 16 Chapter 16-1

General Engineering Standards (GES) - Title 16 of City Code pertains to Street and Utility and Drainage Regulations. In the interest of improving process and customer service, in the area of project design and plan review, GES will supplement this Chapter with comprehensive definitions of engineering practices and standards for plan and project development in relation to the design of public infrastructure for water, sewer, and streets in Prescott.

The GES are 85% complete and have been drafted with the involvement and assistance of many of the local engineering firms in Prescott. The document still needs to be vetted through the development and contractor communities prior to starting the approval process (UDC, Planning and Zoning, and City Council) .

 

Drainage Criteria Manual - The current Drainage Criteria Manual (DCM) was adopted into City Code via Ordinance No. 3581 in February 1997. The DCM addresses engineering issues associated with drainage policies and criteria, drainage design practices, and floodplain management within the City of Prescott. The current DCM has become outdated. The updated DCM will better define stated policies, criteria, and engineering requirements associated with design and construction of facilities within the City of Prescott.

 

In the process of updating with assistance from engineering community. IMportant for flood insurance, etc.

 

McConnell states that this is just a beginning of an ongoing process to keep current. 

 

Comments:

Arnold: Wonders if the Staff can offer individual department review. Says he's correlating budget to code to see if there are opportunities to streamline code to remove obstacles from staff and private sections. 

Lamerson: Agrees with Arnold; thinks there may be some implications for revenue streams and how certain departments are paid for. Wants to streamline, change some things. Maybe how roads are funded. "It looks to me like, we, government, are sometimes our own worst enemy."

McConnell: Will it remove hurdles, will it be more efficient, what are the financial implications? Wants a general question and checklist before making choices.

Blair: Council concerned about risk management being tied into legal department. Answer: We will be addressing this topic in several different areas.

McConnell notes that the fiscal budget will address some of these issues.

Hanna: Needs to make sure they look at themselves as to whether they're bettering themselves. Reiterates that the staff needs to bring input. Suggests every new code means they get rid of two. 

Carlow: Looking at process improvements and budget issues. It's all inter-related.

 

McConnell - they will create a draft schedule for the workshops.

Airport Lease and Rental Agreements - Update Airport Business Plan and align agreements (and fees).
